1. INTRODUCTION
The following General Conditions, regulate the contractual relations between the customers of the website www.pastorinocasa.com (hereinafter referred to as "Customer") and the company of PastorinoCASA that it belongs to Pastorino Luca - Via G. Marsaglia, 51 - 18038 San Remo (IM) - VAT IT00397550088. They come adopted integrally to every order, except for specific written exceptions sent by PastorinoCASA at the Customer. Making a order by the Customer implies the full acceptance of these Conditions of Sale.
2. ORDERS AND PRODUCTS
Every orders will be governed by the provisions of legislative decree number 185/99 ( "Implementation of Directive 97/7/EC on the protection of consumers in respect of distance contracts") and, as regards the protection of sensitive data will be respected legislation referred to the Law number 675/96 and subsequent amendments.
2.1- To purchase products through the website www.pastorinocasa.com you must be at least 18 years of age.
2.2- PastorinoCASA accepts orders received by telephone, by e-mail, fax and mail. Will not come accepted orders carried out with various modalities from those listed above. Every order will have to be completed in every its part and, in particular, the unprovided orders of test of payment will be cancelled.
2.3- All products available on the website www.pastorinocasa.com are available until exhaustion of stocks.
2.4- Product pictures published on-line or in the catalog are not contractual item and may differ from the product that you intend to buy. PastorinoCASA is not responsible for the errors of printing or publication.
3. PRICES
3.1- The price of products reported on the www.pastorinocasa.com website are indicatives and may be changed without notice. Shall prevail, however, the price indicated on the form of the order confirmation that will be sent to the customer upon receipt of the order required.
3.2- Prices are in Euro and they must be understood as inclusive of VAT.
3.3- The shipping charge are excluded, given that they vary based on volume and weight of the goods purchased. The applied rates and the list of countries where PastorinoCASA carries out shipments are available by clicking on "Prices and Shipping". The expense of shipping is borne by the customer and will be added to the price of the product.
4. PAYMENTS
The methods of payment accepted by PastorinoCASA are as the follows:
- Credit Card (PayPal);
- Bank transfer;
- Cash on delivery.
With the exception of cash on delivery, PastorinoCASA will ship the goods only after receiving the relevant and complete test of payment by the Customer.
5. TRANSPORTATION AND DELIVERY
5.1- PastorinoCASA will ship the goods ordered, except where the depletion of inventories at the address indicated by the Customer at the time of writing the order form.
5.2- The time for delivery depends on the method of shipment that the customer has selected (by "Poste Italiane" or by Express Courier).
5.3- Once the customer receives the ordered goods is required to control it completely and if emerges any discrepancy or damaged goods, he must refuse or accept the delivery by compiling the reservation questionnaire and communicating the discrepancies discovered also trough delivery documents.
6. PROPERTY
6.1- The goods remain the property of PastorinoCASA until full payment of their value by the Client.
6.2- Any dispute concerning the nature and / or quality of the goods will be notified to PastorinoCASA only by e-mail and not later than 72 hours after the delivery of the goods.
7. WARRANTY
7.1- PastorinoCASA personally guarantees the quality of its products in addition to the guarantee of the Company that produces the same.
7.2- In case of restitution to PastorinoCASA in order of differences or damaged goods it is necessary to communicate it in advance by mail or by fax at + 39 0184 666 589 and wait for the approval. The products returned to PastorinoCASA without authorization, badly kept, dirty or incomplete will not be accepted.
7.3- For resubmit the goods repaired or replaced PastorinoCASA will only use courier express with cash on delivery.
8. Right of withdrawal
8.1 Pursuant the article 64 and following of Legislative Decree No 206/2005 the consumer has the right to terminate the contract until a period of 10 days from the time of receiving the goods. To exercise the right of withdrawal, the purchaser must give of communication by registered letter with acknowledgment of receipt (within the same term can also send a telegram or a fax, on condition that it provide however to send a confirmation by means of letter registered letter with reception warning within 48 hours). Within the same period of 10 days must return the goods complete and in their original packaging. The shipment is charged and under the responsibility of the sender (we recommend to pack the materials with carefully). The return of material will be accepted unless authorized in advance.
8.2 To exercise the right of withdrawal it is necessary communicate this informations: original document (indicate the order number and / or invoice and in case of partial withdrawal indicate the code of the article or the articles) and the banking coordinates on which to obtain the possible repayment (IBAN code of the holder of the document).
8.3 The repayment will be made as provided by law, as soon as possible, however, within a maximum period of 60 days from receipt of returned goods to the exclusion of transport costs.
8.4 The expedition is under the complete responsibility of the customer until certifyd reception of the goods at our warehouse. In case of damaged goods during transport, PastorinoCASA will communicate with the customer that will have to denounce the courier of his choice to obtain a refund. In this case the product will be returned to Customer and will cancel the request for withdrawal.
The right of withdrawal decays completely, for lack of the essential condition of the integrity of the property (package and / or its contents), in the cases in which PastorinoCASA it finds:
• absence of the outer packaging and / or of the original packaging inside;
• lack of the elements supplied in equipment with the product or anomalies to the same product;
• damages to the product for reasons other than its transport.
Where the right of withdrawal lapses PastorinoCASA will return to Customer the goods acquired by charging the shipping costs to Customer.
8.5 The customers can not exercises the right of withdrawal for purchases made with VAT (in this case is presupposed a professional use of the property that is outside from the norm in protection of the consumer seen like private customer final). Pursuant to Article 64 and following of Legislative Decree No 206/2005, are not subject to the right to withdraw products "made to measure".
